1. Eligibility

By using the Services, you represent and warrant that:

• You are legally capable of entering into binding contracts
• You have not been previously suspended or removed from our Services
• Your use of the Services does not violate any applicable law or regulation

If you are using the Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind such entity to these Terms.

2. Definitions

In these Terms, the following definitions apply:

• "Account" means the account created by a User to access and use the Services.
• "Content" means any text, graphics, images, music, software, audio, video, information, or other materials appearing on or through the Services.
• "Order" means a request to purchase Products through the Services.
• "Products" means the fruits, vegetables, and other items offered for sale through the Services.
• "Subscription" means a recurring Order for Products at specified intervals.
• "User" means an individual who accesses or uses the Services.
• "User Content" means any Content that a User posts, uploads, publishes, submits, or transmits to be made available through the Services.

3. Account Registration and Use

3.1 Account Creation

To use certain features of our Services, you may need to register for an Account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately if you suspect any unauthorized use of your Account.

3.2 Age Requirement

You must be at least 18 years old to create an Account and use our Services. By creating an Account, you represent and warrant that you are at least 18 years old.

3.3 One Account Per User

You may not create more than one Account without our express permission. We reserve the right to terminate any duplicate Accounts.

3.4 Account Termination

We reserve the right to suspend or terminate your Account at any time for any reason, including but not limited to violation of these Terms. You may also terminate your Account at any time by contacting our customer service.

4. Rental Terms and Conditions

4.1 Rental Period

The rental period begins on the date and time specified in your confirmed order and ends on the agreed return date and time. Late returns may incur additional charges as specified in your rental agreement.

4.2 Equipment Availability

All equipment rentals are subject to availability. While we make every effort to ensure the availability of advertised equipment, we reserve the right to substitute equivalent or superior equipment if necessary.

4.3 Equipment Inspection

Upon delivery or pickup, you are required to inspect all equipment and note any visible damage or defects. By accepting delivery, you acknowledge that the equipment is in good working condition unless otherwise noted.

4.4 Equipment Return

All equipment must be returned in the same condition as received, normal wear and tear excepted. Equipment must be properly packed in its original cases or packaging. Missing or damaged items will be charged at replacement cost.

4.5 Technical Support

Technical support is available as specified in your rental agreement. Additional on-site technical support may be arranged for an extra fee, subject to availability.

5. Payments and Fees

5.1 Pricing

All prices are listed in Euros and are subject to change without notice. Prices do not include applicable taxes, delivery fees, or other charges unless specifically stated.

5.2 Deposit

A security deposit may be required for rental orders. The deposit amount will be specified during the booking process and will be refunded within 10 business days after the return of undamaged equipment.

5.3 Payment Methods

We accept payment via major credit cards, bank transfers, and other payment methods as specified on our website. By providing payment information, you represent and warrant that you have the legal right to use the payment method.

5.4 Late Payment

Late payments may incur interest charges at the maximum rate permitted by law. We reserve the right to suspend service to customers with outstanding balances.

5.5 Additional Charges

You may incur additional charges for:

• Late returns
• Equipment damage or loss
• Excessive cleaning requirements
• Technical support beyond what is included in your package
• Delivery or collection outside specified areas or times

6. Equipment Use and Care

6.1 Authorized Use

Rented equipment may only be used by individuals authorized in the rental agreement and for the purpose specified. Equipment may not be subrented or loaned to third parties without our written permission.

6.2 Proper Handling

You agree to:

• Operate equipment according to manufacturer guidelines
• Protect equipment from adverse weather conditions
• Secure equipment when not in use
• Use only compatible accessories and connections
• Prevent unauthorized access to equipment

6.3 Prohibited Actions

The following actions are strictly prohibited:

• Modifying or altering equipment
• Removing or defacing serial numbers or identification
• Operating equipment beyond rated capacity or specifications
• Using equipment in hazardous environments without prior approval
• Transporting equipment outside the specified geographic area without permission

6.4 Loss or Damage

You are responsible for any loss or damage to equipment during the rental period, regardless of cause, except for normal wear and tear. You must report any damage, malfunction, or loss immediately.

7. Liability and Insurance

7.1 Customer Liability

You assume full responsibility for all equipment from the time of delivery or pickup until it is returned to us. This includes liability for damage, theft, or loss, as well as any injuries or property damage arising from the use of the equipment.

7.2 Insurance Requirements

You must maintain appropriate insurance coverage for rented equipment, with coverage limits sufficient to replace all equipment at full retail value. We may require proof of insurance before releasing equipment.

7.3 Our Insurance

Our equipment insurance, if applicable, may cover certain damages subject to deductibles and exclusions. This insurance does not replace your primary responsibility for the equipment.

7.4 Limitation of Liability

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the equipment rental, including but not limited to loss of revenue, profits, or data.

8. Cancellations and Modifications

8.1 Cancellation Policy

Cancellation fees apply as follows:

• More than 7 days before rental date: Full refund minus processing fee
• 3-7 days before rental date: 50% of rental fee
• Less than 3 days before rental date: No refund

8.2 Order Modifications

Requests to modify orders (including date changes, equipment additions, or removals) must be submitted in writing and are subject to availability and additional fees. We cannot guarantee accommodation of modification requests received less than 3 business days before the rental period.

8.3 Force Majeure

If either party is prevented from performing its obligations due to events beyond reasonable control (including but not limited to natural disasters, strikes, or civil unrest), the affected party will be excused from performance during the force majeure event. If the event continues for more than 10 days, either party may cancel the rental without penalty.

9. Intellectual Property Rights

9.1 Our Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by PirateSnap, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose in accordance with these Terms. This license does not include:

• Modifying or copying materials
• Using any materials for commercial purposes
• Attempting to decompile or reverse engineer any software contained on the website
• Removing any copyright or proprietary notations
• Transferring materials to another person

9.3 User Content

By submitting content to our Services (such as reviews, comments, or feedback), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media.

10. Prohibited Uses

You agree not to use the Services:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material, including "spam"
• To impersonate or attempt to impersonate PirateSnap, a PirateSnap employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services
• To use the Services in connection with any illegal activity or to promote illegal activities

11. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Disclaimers

12.1 Equipment Condition

While we make every effort to maintain our equipment in excellent condition, we provide all equipment on an "as is" basis without warranties of any kind, either express or implied.

12.2 Service Interruptions

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

12.3 Third-Party Links

The Services may contain links to third-party websites or services. We are not responsible for the content or practices of any linked websites or services. Any reliance you place on such information is strictly at your own risk.

13. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will PirateSnap, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services, any websites linked to them, any content on the Services or such other websites, or any services or items obtained through the Services or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

14. Indemnification

You agree to defend, indemnify, and hold harmless PirateSnap, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any choice or conflict of law provision or rule.

15.2 Dispute Resolution

Any legal action or proceeding arising out of or relating to these Terms shall be instituted in the courts of the United Kingdom, and you and PirateSnap irrevocably submit to the jurisdiction of such courts in any such action or proceeding.

15.3 Informal Resolution

Before filing a claim against PirateSnap, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or PirateSnap may bring a formal proceeding.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and PirateSnap concerning the Services.

16.2 Waiver

No waiver by PirateSnap of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of PirateSnap to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

16.3 Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

16.4 Assignment

These Terms are personal to you, and you may not assign or transfer these Terms or any rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms or any rights or obligations under these Terms at any time without notice.

16.5 Notices

Any notices or other communications provided by PirateSnap under these Terms will be given by posting to the Services or via email. The date of receipt shall be deemed the date on which such notice is transmitted.
